Terms of Service

These Terms of Service ("Terms") govern your access to and use of PrivaBook, an AI-powered booking management software developed and operated by Fama Labs ("we", "us", "our", "Fama Labs"). By subscribing to, accessing, or using PrivaBook, you ("Client") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
PrivaBook is an AI-powered booking management software delivered as a Software as a Service (SaaS). The Service provides automated WhatsApp booking agents for independent professionals, allowing them to manage client enquiries, filter requests, and confirm appointments automatically via WhatsApp.
Important: Fama Labs is a software provider only. We do not manage, represent, employ, or act as agents for any Client's business. We have no knowledge of, involvement in, or responsibility for the nature, legality, or conduct of any Client's business or the services they offer to their customers.
2. AI Technology
PrivaBook is powered by artificial intelligence technology, including language models developed by Anthropic, PBC ("Claude AI"). By using PrivaBook, you acknowledge and agree that:
- The Service uses AI to generate automated responses to your customers' enquiries
- AI responses are generated automatically and may occasionally contain errors, inaccuracies, or inappropriate content
- The AI does not make final binding decisions. All booking confirmations can be reviewed, modified, or cancelled by the Client at any time via their private panel
- The Client retains full responsibility for all bookings confirmed through the Service, regardless of whether they were confirmed automatically by the AI
- PrivaBook is "powered by AI technology including Anthropic Claude" — this must not be misrepresented to end users
- AI performance may vary and Fama Labs does not guarantee that the AI will always respond accurately or appropriately
3. Audio Feature and Voice Messages
The Pro and Premium plans include an optional audio feature that allows end users to respond to screening questions via WhatsApp voice messages. By enabling this feature, you acknowledge and agree that:
- End users will be informed that their voice message may be analysed by AI before sending
- Voice messages are analysed automatically for tone, language, and content using AI systems
- Automated tone analysis is not 100% accurate and may produce false positives or false negatives
- The Client is solely responsible for listening to audio messages and making the final decision on whether to accept or cancel a booking — the AI analysis is an aid, not a final determination
- The Client must not rely solely on AI tone analysis to make decisions that could affect another person's rights
- Audio files are deleted within 30 days as described in our Privacy Policy
4. Eligibility
- You must be at least 18 years old to use PrivaBook
- By using the Service, you confirm that you are legally permitted to operate your business in your jurisdiction
- You confirm that your use of PrivaBook complies with all applicable laws, regulations, and platform terms in your country and region
- PrivaBook is available to residents of the United Kingdom and the European Union. Use from other jurisdictions is at the Client's own risk and legal responsibility
5. Client Responsibilities
As a Client, you are solely and exclusively responsible for:
- Ensuring your business and all activities conducted through PrivaBook comply with all applicable laws in your jurisdiction, including but not limited to laws relating to the provision of services, advertising, data protection, and consumer rights
- All content of messages sent and received through the Service, including the accuracy of any information provided to your customers
- Configuring the Service appropriately and accurately for your business needs
- Informing your customers that they are interacting with an AI agent — PrivaBook will include an AI disclosure in the first message, and this must not be disabled or modified
- Reviewing automated bookings and exercising your independent judgement before any booking is honoured
- Cancelling any booking that you do not wish to honour, regardless of whether it was confirmed automatically by the AI
- Maintaining the confidentiality of your account credentials and panel access
- Any deposits, payments, disputes, or financial transactions with your customers — Fama Labs has no involvement in or liability for these
- Complying with Meta's WhatsApp Business Terms of Service at all times
- Obtaining any licences, permits, or registrations required to operate your business
6. AI Disclosure Obligation
PrivaBook automatically discloses its AI nature to end users at the start of every conversation. Clients must not modify, disable, or circumvent this disclosure. Misrepresenting the AI nature of the Service to end users is strictly prohibited and may result in immediate account termination.
7. Fama Labs' Role — Limitation of Involvement
Fama Labs expressly states that:
- We provide software tools only and have no knowledge of, control over, or involvement in the Client's business activities
- We do not vet, approve, or endorse any Client's business or the services they offer
- We are not responsible for any interaction between a Client and their customers
- We are not responsible for any outcome arising from the use of automated booking decisions, including any decision to accept or reject a customer
- We are not responsible for the accuracy of AI-generated responses sent to end users
- We are not a party to any contract or arrangement between a Client and their customers
8. Prohibited Uses
You may not use PrivaBook to:
- Facilitate any illegal activity under the laws of England and Wales or your jurisdiction
- Discriminate against any person on the basis of protected characteristics under the Equality Act 2010
- Harass, threaten, stalk, or abuse any person
- Send spam, unsolicited commercial messages, or bulk messages not related to booking management
- Collect, store, or process personal data in violation of UK GDPR, EU GDPR, or any applicable data protection law
- Impersonate any person, business, or entity
- Violate Meta's WhatsApp Business Policy or Acceptable Use Policy
- Attempt to reverse engineer, copy, or replicate any part of the Service
- Use the Service to process bookings for activities that are illegal in the Client's jurisdiction
- Attempt to manipulate, jailbreak, or circumvent the AI systems powering the Service
9. WhatsApp and Meta Compliance
PrivaBook operates on the WhatsApp Business API provided by Meta Platforms, Inc. By using PrivaBook, you agree to comply with Meta's WhatsApp Business Terms of Service, Acceptable Use Policy, and Commerce Policy at all times. Violations of Meta's policies may result in your WhatsApp number being banned by Meta, for which Fama Labs bears no responsibility.
10. Subscription and Payment
PrivaBook is offered on a monthly subscription basis. Current pricing:
- Starter Plan — £35/month: Text messaging only, automated booking management
- Pro Plan — £65/month: Text and audio messaging, voice message analysis, full filtering
- Premium Plan — £95 first month, then £65/month: Full service including personalised onboarding support
The first month is free for new Clients. No payment details are required during the free trial. Subscriptions renew automatically on a monthly basis unless cancelled. No refunds are provided for partial months.
11. Cancellation and Data Deletion
You may cancel your subscription at any time by contacting hello@famalabs.co.uk or using the cancellation option in your panel. Upon cancellation:
- The Service remains active until the end of the current billing period
- All personal data associated with your account will be permanently deleted within 30 days of cancellation
- This deletion is irreversible — please export any data you wish to retain before cancelling
12. Suspension and Termination
We reserve the right to suspend or terminate your account immediately and without notice if you:
- Violate any provision of these Terms
- Engage in illegal activity using the Service
- Violate Meta's WhatsApp Business policies
- Fail to pay your subscription fee
- Use the Service in a way that causes harm to others or reputational damage to Fama Labs
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- Fama Labs provides PrivaBook "as is" and "as available" without warranties of any kind, express or implied
- We do not warrant that the Service will be uninterrupted, error-free, or that AI responses will always be accurate
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- We are not liable for any loss of revenue, loss of data, or business interruption arising from use of or inability to use the Service
- We are not liable for any outcome of an automated booking decision made by the AI — the Client is solely responsible for reviewing and acting on all bookings
- We are not liable for any action taken by Meta including suspension or banning of your WhatsApp number
- Our total aggregate liability to you for any claim arising from these Terms shall not exceed the total amount you paid us in the 3 months preceding the claim
14. Indemnification
You agree to indemnify, defend, and hold harmless Fama Labs, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any claim by a third party arising from your business activities conducted using PrivaBook
- Any claim relating to the nature of your business or the services you offer to your customers
15. Intellectual Property
PrivaBook and all associated software, designs, algorithms, content, and branding are the intellectual property of Fama Labs. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your active subscription. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our written permission.
16. Confidentiality
Both parties agree to keep confidential any non-public information shared in connection with the Service. This obligation survives termination of these Terms.
17. Force Majeure
Fama Labs shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to Meta platform outages, internet disruptions, acts of God, or government actions.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fama Labs regarding the Service and supersede all prior agreements and understandings.
21. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
